General Terms of Use

Applicability
SousChef B.V. (hereinafter: ‘SousChef’) is the publisher of the SousChef app and websites and is located and has its office at Europalaan 100, 3526 KS Utrecht. Each visit to the SousChef websites and the use of the SousChef apps and the SousChef account are subject to these terms of use (hereinafter: ‘Terms of Use’).
By visiting the website(s) or using the app(s), you implicitly and unconditionally agree to the applicability of these Terms of Use. When creating a SousChef account, you explicitly agree to these Terms of Use. SousChef may amend these Terms of Use at any time. The amended Terms of Use are valid from the moment they are published. You can find the publication date of the latest version of the Terms of Use at the top of this page. We therefore advise you to check the Terms of Use regularly.
Liability
Despite the constant care and attention that SousChef dedicates to the composition of its websites and apps, it is possible that information published on these websites and apps may not be complete, accurate, or up-to-date. The information offered on or via these websites and apps is subject to change, and any modifications may be made at any time with immediate effect and without prior notice. SousChef does not guarantee that the websites and apps will be continuously available without interruption. SousChef reserves the right to optimize or adjust the technical characteristics and accessibility of the websites without notice. SousChef disclaims all liability for any direct or indirect damages, of any kind, arising from or in any way related to the use of the websites or apps, the use of information obtained through the websites or apps, or the temporary inability to access the websites or apps.
Access to and Use of Our Websites and Apps
You have the right to use our websites and apps for personal purposes. Commercial use (such as using parts of the websites and apps to generate advertising revenue or partially reproducing content) is prohibited. You may not interfere with the normal operation of our websites and apps and must adhere to the following code of conduct on our websites and apps:
- Do not infringe upon the (intellectual property) rights of SousChef or the authors, broadly defined, who publish works on our websites and apps.
- Do not interfere with other visitors’ use of our websites or apps.
- Do not distribute spam, viruses, malware, or any other inappropriate messages or information through our websites and apps.
- Do not bypass or interfere with the security of our websites and apps.
- Do not use any tools for searching or indexing (parts of) our websites and apps, such as robots or spiders. Search engines must adhere to the robots.txt protocol.
- For (parts of) the websites and apps that require a SousChef account, comply with the rules regarding “SousChef account” and “Code of Conduct for Posting Content” outlined below.
In case of non-compliance with one or more of these rules of conduct, SousChef reserves the right to deny you access to our websites and apps.
Links to Other Websites
Our websites and apps contain links to third-party websites. This does not mean that SousChef recommends these websites, agrees with their content, or collaborates with them in any way. Nor does SousChef provide any guarantee regarding the suitability, accuracy, completeness, or safety of these websites. Therefore, SousChef is not responsible for such websites or the information provided on them.
Intellectual Property Rights
The rights related to SousChef’s trademarks and associated logos, such as copyrights and trademark rights, are held exclusively by SousChef and its group companies. SousChef expressly reserves these rights.
The intellectual property rights (including copyright, database, and related rights) concerning the content and layout (the included data, videos, images, sounds, texts, and other information) of the websites, apps, and digital publications of SousChef brands are held exclusively by SousChef and/or its licensors, and these rights are expressly reserved by them. This content and layout are intended for personal, non-commercial use only. Without prior written permission from SousChef, it is not permitted to reproduce, distribute, reuse, retrieve, or otherwise copy or publicly display the content and/or layout, in whole or in part, except to the extent strictly necessary for personal, non-commercial use. Reproductions for the purpose of text and data mining using software (or any other automated system) (“screen scraping”) or otherwise are also expressly prohibited, with the exception of reproductions made by research organizations and cultural heritage institutions for scientific research as defined in Article 15n of the Copyright Act.
SousChef has the right, but not the obligation, to deny access to information or to remove information if, at SousChef’s sole discretion, there is (potential) infringement of third-party rights.
SousChef Account
If you create a SousChef account on one of our websites or in one of our apps, you expressly agree to:
- provide accurate, current, and complete information as requested when creating the SousChef account, and
- promptly update this information in the event of any changes.
After creating a SousChef account, you will receive a confirmation email. Your login credentials (username and password) are strictly personal. It is not permitted to exploit or share your login credentials with third parties. With a SousChef account, you are allowed to use the SousChef websites and apps on a maximum of five (5) web browsers and/or devices with apps logged in simultaneously. If you suspect that your login credentials have fallen into the hands of third parties, you are required to notify SousChef immediately at privacy@souschef.app. If SousChef detects a violation of the allowed number of web browsers and/or devices with apps, we may ask you to change your password or log out. This helps us prevent the misuse of SousChef accounts.
SousChef reserves the right to temporarily or permanently block a SousChef account at any time, for example, if a user is deemed by SousChef to be acting in violation of these Terms of Use, including but not limited to exceeding the permitted number of logged-in web browsers and/or devices with apps.
Code of Conduct for Posting Content
If you have created a SousChef account and/or the relevant website or app provides the option to post content (such as recipes, lists, comments, messages, photos, videos, personal information, etc.), the following code of conduct applies:
- Be polite
- Identify yourself
- Provide reasons for your opinion
- Write in clear, polite, and proper language
- Do not insult other users, authors, or individuals.
- Do not discriminate, offend, or incite hatred or violence.
- Do not engage in digital shouting (excessive use of capital letters, question marks, exclamation points, etc.).
- Do not post advertisements.
- Do not post personal data of third parties.
- Do not infringe on the (intellectual property) rights of others.
- Do not post links to unlawful publications or illegal items (software, music, etc.).
- If you include a link in your comment, explain why the link is relevant or what it adds to the discussion.
SousChef disclaims all liability for any comments or content posted by you or third parties. You are solely responsible and indemnify
SousChef and its affiliated companies from any third-party claims and related damages, fines, and costs associated with the content and comments you post. SousChef reserves the right to edit, fully remove, or reject comments without further explanation.
By posting any content on our websites and apps, you grant SousChef and its affiliated companies a perpetual, unconditional license to disclose, reproduce, store, or otherwise use or exploit this content, in whole or in part, in any manner, form, or medium. If you are not the rights holder of the posted content, you must obtain permission from the rights holder before posting and mention the rights holder’s name if they request it. Additionally, if you post or submit images, you must have the consent of the person(s) portrayed.
Privacy
SousChef’s privacy statement applies to the processing of personal data through SousChef’s websites and apps and forms an integral part of these terms.
Final Provision
These Terms of Use and any disputes arising from or related to the use of the SousChef account are governed by Dutch law. The court in Midden-Nederland has exclusive jurisdiction over such disputes.
