Privacy Statement

SousChef B.V. (hereinafter: “SousChef”) is the publisher of the SousChef app and websites. This privacy statement applies to all apps and websites of SousChef.

SousChef is located and has its office at Europalaan 100, 3526 KS Utrecht. The ICT activities of SousChef are centrally carried out and managed at the SousChef headquarters in Utrecht, the Netherlands. Many of the personal data managed by SousChef are stored and administered there. Personal data of users of SousChef’s products and services are handled with care and safeguarded in accordance with relevant laws and regulations, including the General Data Protection Regulation (GDPR). This privacy statement provides you with further information on this matter.

 

Recording and Processing of Personal Data

When you use one of SousChef’s services or purchase a SousChef product, your personal data is processed. This occurs in various ways, for different purposes, and SousChef applies different retention periods. In the text below, “data” also refers to personal data. See below to find which category applies to you:

 

Are you receiving an email from SousChef?

If you give your consent, SousChef will use your email address to send a general or personalized newsletter, offers, and/or product information. We retain your email address for sending emails until you withdraw your consent. You can unsubscribe from receiving emails or withdraw your consent at any time by using the ‘unsubscribe’ button at the bottom of the email. In our emails, we use techniques that measure the effectiveness of our services and help us improve the emails.

Are you receiving generic or personalized push notifications from SousChef?

If you give your consent, SousChef sends general or personalized push notifications. For this purpose, SousChef processes data about your device. You can withdraw this consent through the settings in your browser and in the app if you no longer wish to receive these notifications. We retain the data about your device until you withdraw your consent.

Are you an online visitor of the SousChef websites or a user of the SousChef apps?

When you visit our websites or use our apps, you are asked if we may use cookies. These cookies collect information about your device, location, browser, and browsing behavior. We use this information for various purposes. You can give consent for placing these cookies or set your own preferences. You can adjust your consent or preferences at any time by clicking on ‘privacy settings’ at the bottom of the page. For more information about the use of cookies, please refer to our cookie statement. When you consent to the placement of cookies for the purposes of personalized ads, personalization, and marketing, the information collected is added to your compiled profile. For more information, please refer to the category ‘Compiled Profile.’ The retention period for online data is twenty-six months. Do you have a SousChef account?

With a SousChef account, you can log into all SousChef services with a single username and password. SousChef processes the data you provide to manage the account, such as contact information, account history, email address, and date of birth. If you post comments with your SousChef account under content on SousChef websites or on a SousChef forum, SousChef links the content of those comments to your account information. If you have given consent, SousChef uses your account information to create a compiled profile. For more information, refer to the category ‘Compiled Profile.’ Additionally, your age will be used for age verification, and your name to address you personally. After a period of two years of inactivity on your SousChef account, your account will be deleted. You will be informed of this via email in advance. If you do not take any action following this notification, your account will be deleted.

 

Are you applying for a position at SousChef?

SousChef uses your personal data to process your application. The following data, among others, are processed: first name, last name, gender, date of birth, address, postal code, city, phone number, email address, education level, availability, CV, and motivation. The data you provide to SousChef, including your CV and motivation, are retained by SousChef for a period of four months from the date you apply. If you have given consent, your data will only be deleted after one year. If you are hired by SousChef, your data will become part of the personnel file and will be retained for up to two years after the end of employment. If you visit the SousChef office during the application process, data such as camera footage will be processed. Are you a visitor to the SousChef office?

SousChef processes personal data of visitors to its physical office. This includes camera footage and contact information such as name, email address, and job details. SousChef processes these data based on its legitimate interest, and they are retained for one month.

 

Are you an advertiser or a business partner with or of SousChef?

SousChef uses the contact details, account information, and professional data about your work and employer that you provide to fulfill the agreements made with you and to deliver the agreed services, products, and information. SousChef also uses your data for direct marketing purposes, allowing similar offers to be made to you. Your data is retained for up to seven years after the end of the agreement.

Compiled Profile

If you have given consent, SousChef uses your cookie data, account data, and subscriber data to create a compiled profile. Your cookie data includes information about your device, location, browser, and browsing behavior. Your account data includes the following details: name, form of address, date of birth, address, postal code, email address, city, phone number, household size, taste and dietary preferences, kitchen equipment, and utensils. SousChef uses these profiles for the following purposes:

    • personalizing advertisements;

    • measuring advertisement performance and deriving insights about the audience that viewed the advertisements and content;

    • improving the user experience, systems, and software;

    • personalizing products and services, allowing us to recommend or provide you with recipes, ingredients, equipment, and/or kitchenware that match your interests;

    • improving our products and services and tailoring them as closely as possible to our customers’ needs;

    • displaying advertisements for our products and services on other websites and apps;

    • informing you about other products and services from SousChef.

You can easily view, give, modify, or withdraw your consent via ‘privacy settings’ at the bottom of each website or through the menu in each app.

 

Legitimate (Business) Interests

SousChef may also process your data when necessary to protect its legitimate (business) interests, unless your interests, fundamental rights, or freedoms outweigh these interests. To determine whether processing can occur based on this legal ground, a prior balancing of interests will be conducted between SousChef’s interests and the interests of the individuals involved. Processing activities aimed at analyzing, maintaining, and optimizing our (mobile) websites, apps, and related technologies, as well as fraud prevention, may occur on this legal ground if a prior and careful balancing of interests favors business interests. We also conduct market research and compile management information to support product and service development and to determine our (general) strategy.

 

Children Under 16

We offer a number of products and services that are (also) aimed at children. The parent(s) or legal representative(s) of children under 16 years of age should read this privacy statement in the best interest of the child. SousChef makes every effort to avoid processing personal data of children under 16 years of age without the consent of the child’s parent(s) or legal representative(s). Children under 16 may only create and use a SousChef account with the permission of their parent(s) or legal representative(s). Additionally, they may only subscribe to newsletters with information and offers if their parent(s) or legal representative(s) consent. Parent(s) and legal representative(s) may view, correct, or delete the personal data on behalf of the child under 16. On our websites and apps, a child can indicate that they are a child. In that case, we do not display targeted advertisements and do not place tracking cookies or similar technologies, nor cookies or similar technologies that would allow us to build a compiled profile of the visitor. If you believe that SousChef has collected personal data about a minor without parental consent, please contact us at privacy@souschef.app so that this information can be deleted.

 

Telephone Calls

Telephone calls with you may be recorded by SousChef for training and analysis purposes. The audio recordings are retained for two months.

 

Data Security

SousChef uses security procedures to protect the processed data, including preventing unauthorized access to the data, preventing fraud, and logging any disruptions. If there are indications of misuse, please contact us at privacy@souschef.app.

Data Sharing with Third Parties

SousChef always asks for your explicit consent before sharing your personal data with third parties, unless one of the situations described below applies. SousChef engages third parties in the execution of its services. To the extent that these third parties process personal data while providing their services, they do so as data processors. All of our processors are required to protect your personal data. We enter into agreements with our processors in which this obligation is explicitly stated. In special cases, we may provide personal data to third parties without your consent. Special cases include lawful requests from authorities, subpoenas or court orders, actions to detect or prevent damage or fraud, or actions to ensure the security of our network and services. Finally, we may share certain anonymized data with third parties, such as the number of users who searched for a specific term or how many users clicked on a particular advertisement. These data cannot be used to identify you.

 

Transfer to Third Countries

When SousChef transfers personal data to third parties for processing in countries outside the European Economic Area, SousChef ensures that the data is transferred and processed in a manner that complies with applicable privacy laws.

 

Voice Actions

SousChef uses voice commands. With voice actions, you can control the app hands-free and give spoken commands such as “next” and “repeat” to the SousChef app. We receive certain data to respond to your spoken commands. By providing the data to us, you consent before using the app. We use this data to execute and operate the service. We also use aggregated data on the use of SousChef Voice Actions to compile statistics and optimize the quality of our app. We do not store audio files of your interactions with the app. However, we receive a transcript, which we use for the purposes mentioned above. The transcripts of your interactions with our Voice Actions are retained for 1 year.

 

View, Modify, or Delete Data

You have the right to view, modify, or delete your personal data. You can use this form for such requests. If you have a question or request that cannot be submitted via the form, you can email privacy@souschef.app.SousChef will generally respond to a request for access or modification within four weeks. In the case of a deletion request, SousChef will remove the relevant personal data as soon as possible, unless the law requires the data to be retained or there are (other) urgent reasons preventing deletion. SousChef will send you a confirmation message once the deletion request has been carried out. If SousChef has not removed (part of) the relevant personal data, SousChef will send you a message explaining why the request could not be fully fulfilled. If SousChef is unable to fully determine which personal data a request for access, modification, or deletion pertains to, SousChef may ask you to further specify your request. The execution of the request will then be suspended until you provide the additional specification. For the data related to your request, SousChef may use all the data known to it about you, including data linked to your account. You can object to the use of your personal data for direct marketing purposes or other processing by sending a message to privacy@souschef.app.

 

Changes

SousChef reserves the right to make changes to the privacy statement. Therefore, please check the privacy statement regularly for any updates.
